Scope

These Terms and Conditions apply to the use of the website gsoond.com, to bookings of paid workshops and events (e.g. SHE EATS, SHE SINGS) made through it, and to access to the SHE Portal, which customers receive after a purchase. They apply to all visitors of the website as well as to customers who make a booking or use the SHE Portal. Individual contractual agreements, for example within B2B or municipal partnerships, take precedence over these Terms and Conditions.

Description of Services

gsoond.com is the website of gsoond gmbh for the SHE programmes offered by Dr. Gerhilt Kusatz (including SHE EATS, SHE SINGS, SHE LOVES). Through the website we provide information about our offerings, provide free supporting features (e.g. SHE asks, the protein/fibre calculator) and enable the online booking of paid workshops and events with a fixed date. No registration or user account is required for this.

The information and features provided on gsoond.com serve general information and support purposes. They do not replace an individual medical examination, diagnosis or treatment, unless such a service has been expressly agreed (see also the medical disclaimer in our Imprint).

SHE Portal — Access and Use

Customers who have booked a paid service from us additionally receive access to the SHE Portal, our protected customer area for supporting their SHE programme.

In addition to these Terms and Conditions, the following applies to Portal access:

• Login credentials must be treated as confidential and must not be shared with third parties. If you suspect unauthorised access, please inform us immediately at impressum@gsoond.com.
• We may restrict or suspend access if these Terms and Conditions are violated or there is reasonable suspicion of misuse.
• Portal access does not end automatically after participating in a single workshop. It remains in place until you request deletion of your access or we end it for good cause.

Permitted Use

The website and its features must not be used to

• violate applicable law,
• circumvent security measures or technically attack the system,
• distribute malicious software,
• infringe the copyright or trademark rights of third parties,
• knowingly provide false or abusive information, for example when making a booking.

In case of misuse, for example automated bulk requests to our AI-supported features, we may restrict access (see also our Privacy Policy, section "Server Logs").

Free Features (SHE asks, protein/fibre calculator)

These features support you with general information and are generated using artificial intelligence. They serve exclusively as support and do not replace individual professional or medical assessment. Results may be inaccurate or incomplete and should be reviewed by a qualified person before important decisions. Details on data processing can be found in our Privacy Policy.

Booking, Prices and Payment

Paid workshops and events can be booked directly at /en/appointments. All prices shown are final prices in euros, including statutory VAT.

After filling out the booking form, you will be redirected to our payment provider Stripe for payment processing. There, the amount to be paid is shown again; by completing payment on the Stripe checkout page, you place an order with an obligation to pay. Stripe's own terms of use apply in addition.

The booking becomes binding once payment has been successfully completed; you will receive a confirmation afterwards.

Conclusion of Contract and Right of Withdrawal

The contract for participation in a workshop or event is concluded once payment has been successfully completed.

As the booked services are leisure-related services for which the contract provides a specific date, the statutory 14-day right of withdrawal does not apply, pursuant to Section 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG).

Intellectual Property

Texts, images and other content on gsoond.com are protected by copyright. Reproduction, publication or commercial distribution is only permitted with the prior consent of gsoond gmbh. Further information can be found in our Imprint.

Availability

We make every effort to keep the website and its features continuously available, but cannot guarantee uninterrupted availability, for example due to maintenance work or dependence on external services (including Stripe). Statutory rights of consumers remain unaffected.

Liability and Warranty

We are liable only for intent or gross negligence, as well as within the scope of mandatory statutory provisions, in particular for personal injury and within the scope of the Austrian Product Liability Act. Statutory warranty rights of consumers remain unaffected.

Data Protection

Information on the processing of personal data can be found in our Privacy Policy. Data protection and these Terms and Conditions are separate documents.

Changes to these Terms

We may update these Terms and Conditions where this is necessary for legal, technical or organisational reasons. For bookings already concluded, the Terms and Conditions valid at the time of booking apply.

Applicable Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
